South Korea: cross-border crypto transfers and taxation follow separate timetables

Seoul is preparing rules to monitor cryptoasset transfers while taxation remains scheduled for 2027. Official documents distinguish the enacted law, its proposed implementing decree and income tax.

An implementing decree still under consultation

South Korea is refining its framework for monitoring cryptoasset transfers. In a statement dated October 6, 2026, the Ministry of Finance and Economy presents a proposed amendment to the implementing decree of the Foreign Exchange Transactions Act. The announced consultation runs from October 7, 2026 to October 26, 2026. This proposal must be distinguished from legislation already enacted.

The ministry says the amended law, promulgated on June 2, 2026, is scheduled to take effect on December 3, 2026. The decree specifies matters including transfer providers' registration and information-reporting obligations. During the consultation, the proposed arrangements remain subject to the announced regulatory stages; they should not be described as an entirely operational system.

The central bank's role in reporting

The scope presented includes transfers between domestic and overseas providers, as well as transactions between domestic providers and personal wallets. The proposal sets organisational and staffing requirements for the registration of affected businesses. Its purpose is to make flows more visible to the authorities overseeing foreign exchange transactions and combating unlawful activity.

Reports are intended to feed the Bank of Korea's foreign exchange information system. Data would be shared with the tax administration, customs and financial authorities named by the ministry. This information-gathering role does not mean the central bank alone enacts the law or determines taxation. The ministry is describing implementation of a legislative framework involving several authorities at different stages.

A separate tax deadline in 2027

South Korea's tax administration recalls that an amendment passed in December 2024 postponed taxation of cryptoasset income. The official timetable covers disposals and lending from January 1, 2027. The stated scope concerns income from those operations; it does not justify claiming that every token-related activity receives identical treatment.

The calculation described takes account of proceeds, acquisition costs and allowable expenses. Specific acquisition-value rules are provided for assets held before implementation. This tax framework has a different purpose from transfer reporting: identifying an asset movement and calculating taxable income do not answer the same question.

For users and businesses, the useful information is therefore each text's status and application date. Consultation does not constitute final adoption of every provision; discussion of a postponement does not automatically alter the published timetable. Monitoring should focus on the rules ultimately adopted and operational guidance from the authorities, without confusing cross-border oversight with the creation of a new tax.
